What if someone died? Can the family sue?

Yes.  The legal process starts with official appointment of someone, usually a family member, as the “personal representative” or “administrator” of the estate of the deceased person. That person then acts on behalf of the surviving family members.  Any money recovered is divided among the relatives of the deceased, either by agreement among the survivors or by some neutral process set up by the court.
