The failure of an implanted device, whether a heart pacemaker or a hip replacement, often generates a lawsuit against the manufacturer of the device. One big problem with medical device regulation in the United States is that many devices get “grandfathered” into approval by the FDA. All the manufacturer has to show is that the device is similar to an older device that the FDA previously approved. But this system is not working. Of more than 100 recalls of defective devices, seven in ten had been approved by this grandfathering process, according to a recent study.
